RE: The tariff classification of valves and valve parts of unspecified origin

Dear Mr. Panjwani:

In your letter dated February 24, 2012 you requested a tariff classification ruling. Descriptive information was submitted.

The articles in question are described as a bonnet assembly, a float chamber, a cover trap, and an in-line air separator. The in-line air separator is an appliance designed for use in hydronic heating/cooling systems to separate out free air within the system by decelerating fluid flow. The float chamber is a water cut-off valve for water and steam boilers. The cover trap is a steam trap assembly used with boilers to remove water/condensate from steam to improve the safety and efficiency of the boiler. The bonnet assembly is an integral part of a hand operated valve used to guide the valve stem that opens and closes the valve disk.

The applicable subheading for the float chamber will be 8481.80.9010, Harmonized Tariff Schedule of the United States (HTSUS), which provides for other taps, cocks, valves and similar appliances incorporating ballcock mechanisms. The general rate of duty will be 2 percent ad valorem.

The applicable subheading for the cover trap and in-line air separator will be 8481.80.9015, HTSUS, which provides for regulator valves, self-operating, for controlling variables such as temperature, pressure, flow and liquid level. The general rate of duty will be 2 percent ad valorem.

The applicable subheading for the bonnet assembly, if of copper or its alloys, including brass, will be 8481.90.1000, HTSUS, which provides for parts of hand operated and check appliances, of copper. The general rate of duty will be 3 percent ad valorem.

The applicable subheading for the bonnet assembly, if of iron or steel, will be 8481.90.3000, HTSUS, which provides for parts of hand operated and check appliances, of iron or steel. The general rate of duty will be 5 percent ad valorem.

The applicable subheading for the bonnet assembly, if of materials other than copper, iron or steel, will be 8481.90.5000, HTSUS, which provides for parts of hand operated and check appliances, of other materials. The general rate of duty will be 3 percent ad valorem.

This ruling is being issued under the provisions of Part 177 of the Customs Regulations (19 C.F.R. 177).
